Legal Guarantee
Statutory legal guarantee rights apply to all goods purchased from Dynabrixx. On this page you can find information about what the legal guarantee means, when a lack of conformity may exist, and which types of damage are not covered by the legal guarantee.
What does the legal guarantee mean?
The legal guarantee applies to defects or lack of conformity. In simple terms, the goods must comply with the agreed and legally required characteristics at the time they are delivered.
A lack of conformity may exist, for example, if an item already had a material, manufacturing or workmanship defect at the time of delivery, or if it does not perform the agreed function.
However, the legal guarantee is not a guarantee that a product will remain free from wear or damage for two years regardless of use, assembly, mechanical stress or handling.
How long do legal guarantee rights apply?
For new goods, the statutory limitation period for claims relating to defects is generally two years from delivery.
This does not mean that every type of damage or loss of function occurring within these two years automatically constitutes a lack of conformity. The cause of the condition is an important factor.
What is not covered by the legal guarantee?
Damage that occurs only after delivery as a result of use, wear, incorrect assembly, improper handling or excessive stress generally does not constitute a lack of conformity where the damage was caused by such circumstances.
This may include in particular:
- normal wear and ordinary signs of use,
- damage caused by improper or unintended use,
- damage caused by excessive mechanical stress, bending or jamming,
- damage caused by excessive force during assembly or disassembly,
- damage to moving parts caused by incorrect handling or blocked mechanisms,
- damage to tracks, switches or connecting elements caused by incorrect assembly,
- damage caused by unsuitable motors, electrical components or incorrect power supply,
- damage resulting from modifications, drilling, gluing or other alterations,
- damage caused by impact, pressure, heat, moisture or other external influences,
- material-related variations in colour, surface or dimensions within normal tolerances, provided that the agreed function and usability are not affected.
Special information for tracks, switches and model railway components
Tracks, switches and moving model railway components are intended for proper use within a suitable setup. Please ensure that components are installed without undue mechanical stress and are used according to their intended function.
In particular, strong lateral forces, jamming, forced operation or unsuitable loads can permanently damage moving parts.
Damage demonstrably caused by such treatment is not the result of an original material or manufacturing defect.
What happens if a product is defective?
If a statutory lack of conformity exists, you are entitled to the legal remedies provided by law. These generally include, in the first instance, bringing the goods into conformity, for example by repair or, where the legal requirements are met, replacement with conforming goods.
Under the applicable legal conditions, additional remedies such as a price reduction or termination of the contract may also be available.
Having a problem with an item?
If you believe that an item purchased from us has a defect or lack of conformity, please contact us via our contact page.
Please describe the issue as accurately as possible and, if possible, include photos clearly showing the item and the affected area. For functional issues, a short description of the setup and components used is also helpful.
